Terms of Service

These Terms of Service ("Terms") govern your use of the BodyPal mobile application and any related services (the "Service"), provided by Vancko Systems LTD ("BodyPal", "we", "us", or "our"). By downloading, installing, or using BodyPal, you agree to these Terms. If you do not agree, do not use the Service.
Operator
BodyPal is operated by Vancko Systems LTD, a company registered in Bulgaria (UIC: 208812009, VAT: BG208812009), with registered office at 72 Knyaginya Maria Luiza Blvd, Floor 2, Office 18, 4000 Plovdiv, Bulgaria. Contact: support@bodypalapp.com.
1. Eligibility
You must be at least 18 years old to use BodyPal. BodyPal is designed for adults and uses adult body-mass and energy-expenditure calculations that are not appropriate for minors. BodyPal is not intended for, and may not be used by, anyone under 18. We do not knowingly collect data from anyone under 18.
2. Your account
BodyPal uses Sign in with Apple to create your account at the end of onboarding. Apple shares with us a stable opaque user identifier and, only if you choose to share them, your name and an email address (which may be Apple's privacy relay address). We do not see or store your Apple ID password. You are responsible for keeping your Apple ID and device secure. If you revoke Sign in with Apple for BodyPal in your iOS settings, your in-app data may become inaccessible to you and will be deleted from our servers after a reasonable backup window.
3. Subscriptions and billing
BodyPal offers a free trial followed by an auto-renewing subscription ("BodyPal Premium") that unlocks unlimited AI photo scans, persistent photos for foods you favorite (kept while your subscription is active, beyond the 35-day retention that applies to all other meal photos), and other premium features. The trial length is shown on the in-app paywall before you purchase.
- Payment: All purchases are processed by Apple through your Apple ID. BodyPal does not see or store your payment details.
- Auto-renewal: Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
- Cancellation: Manage or cancel anytime in Settings → Apple ID → Subscriptions on your iPhone.
- Refunds: Refund requests are handled by Apple at reportaproblem.apple.com. BodyPal cannot issue refunds directly.
- Price changes: If we change the subscription price, we will notify you in advance and you may cancel before the change takes effect.
- Trial conversion: BodyPal Premium starts with a free trial. If you do not cancel at least 24 hours before the trial ends, your Apple ID will be charged for the first paid subscription period automatically, and the subscription will renew at the displayed price each period until you cancel.
3.5 EU consumer right of withdrawal
If you are a consumer residing in the EU/EEA, you have the right to withdraw from this contract within 14 days without giving any reason, under Article 9 of EU Directive 2011/83/EU (transposed into Bulgarian law by the Consumer Protection Act). The withdrawal period expires 14 days after the day on which the contract is concluded.
To exercise your right of withdrawal, you must inform us at support@bodypalapp.com with a clear statement (e.g., a letter sent by email) of your decision to withdraw from this contract. To meet the deadline, it is sufficient to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
Loss of withdrawal right for digital content. By starting to use BodyPal Premium during a free trial OR immediately after purchase, you expressly consent to the immediate performance of the service and acknowledge that you lose your right of withdrawal once the service has been fully performed (Article 16(m) of Directive 2011/83/EU).
Refunds for App Store purchases are processed by Apple and not by BodyPal. To request a refund, visit reportaproblem.apple.com or follow Apple's instructions at Settings → [Your Name] → Subscriptions on your iPhone. We have no control over Apple's refund decisions.
4. Acceptable use
You agree not to:
- Use BodyPal for any illegal, harmful, or fraudulent purpose;
- Attempt to bypass rate limits, authentication, or other security mechanisms in order to abuse our AI endpoints;
- Reverse engineer, decompile, or extract the source code of the app, except as permitted by applicable law;
- Resell, sublicense, or redistribute the Service or any part of it;
- Upload content that is illegal, infringing, or that contains malware.
We may suspend or terminate your access if we reasonably believe you have violated these Terms.
5. Health and dietary disclaimer
BodyPal is not a medical device and does not provide medical, nutritional, or dietary advice. Calorie estimates, macro breakdowns, and any guidance produced by BodyPal's AI are estimates for general informational purposes only.
- Always consult a qualified physician or registered dietitian before changing your diet, especially if you have a medical condition, are pregnant or nursing, are under 18, or have a history of disordered eating.
- AI-generated calorie and macro values may be inaccurate. Use BodyPal as a rough guide, not as a precise scientific instrument.
- BodyPal does not diagnose, treat, cure, or prevent any disease.
You use BodyPal at your own risk. Do not rely on BodyPal for life-critical decisions.
6. User content
"User Content" means anything you submit to BodyPal: meal photos, food entries, weight and water logs, and similar inputs. You retain ownership of your User Content. By submitting it, you grant BodyPal a worldwide, non-exclusive, royalty-free license to use, host, and process the User Content solely to operate and improve the Service (for example, to send a meal photo to our AI for analysis and store the resulting log).
You are responsible for the User Content you submit and represent that you have the right to submit it.
6.1 Recipes you build
BodyPal lets you create and save your own recipes by combining ingredients drawn from our nutrition database (sourced from USDA FoodData Central and Open Food Facts — see §9). The per-ingredient and total calorie and macro values shown for a recipe are calculated estimates based on those databases and the portion sizes you enter; they have not been kitchen-tested or reviewed by a registered dietitian or chef.
User responsibility and risk. You are solely responsible for evaluating the suitability of any recipe you build for your individual dietary needs, allergies, medical conditions, and religious or cultural restrictions, and for following standard food-safety practices (cooking temperatures, refrigeration, produce washing). BodyPal cannot detect cross-contamination, hidden ingredients in commercial products, or your individual sensitivities. If you are unsure whether a recipe is appropriate for you, consult a qualified dietitian or physician before preparing it.
Liability. To the maximum extent permitted by applicable law, BodyPal is not liable for any injury, illness, allergic reaction, food poisoning, or other harm resulting from the preparation or consumption of recipes you build in the app.
7. AI outputs
BodyPal uses third-party AI models (Google Gemini 2.5 Flash) to generate calorie estimates and meal-related responses. AI outputs:
- May be inaccurate, incomplete, or inconsistent;
- Should not be relied upon for medical, legal, financial, or safety-critical decisions;
- Are provided "as is" without any warranty of correctness.
8. Intellectual property
The BodyPal app, name, logo, and all related materials are owned by us and protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable license to use BodyPal for personal, non-commercial purposes in accordance with these Terms.
9. Third-party services
BodyPal uses third-party services to operate (Apple, Google Firebase, Google Generative Language API, fal.ai, RevenueCat, AppsFlyer). Your use of those services through BodyPal is subject to their own terms and privacy policies, summarized in our Privacy Policy.
Third-party data attribution. BodyPal's food database includes information from Open Food Facts, made available under the Open Database License (ODbL), and from the U.S. Department of Agriculture's FoodData Central (public domain). Nutrition values returned by BodyPal may originate from either source and are provided "as is" — BodyPal does not guarantee the accuracy of third-party database entries.
10. Termination
You may stop using BodyPal at any time. To permanently delete your BodyPal account and all associated data from our servers, open BodyPal → Settings → Delete Account inside the app and confirm; this is the primary, in-app deletion path required by Apple App Store Guideline 5.1.1(v). You may additionally cancel any active subscription via iPhone Settings → Apple ID → Subscriptions, revoke Sign in with Apple for BodyPal in your iOS settings, and uninstall the app. We may terminate or suspend your access to the Service if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.
11. Disclaimers
To the maximum extent permitted by law, BodyPal is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate.
12. Limitation of liability
To the maximum extent permitted by law, BodyPal and its developers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill arising from your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid to us, if any, in the 12 months before the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless BodyPal and its developers from any claim, damage, liability, or cost arising from your violation of these Terms or your misuse of the Service.
14. Changes to these Terms
We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the app. Continued use of BodyPal after a change constitutes acceptance of the revised Terms.
14a. Entire agreement
These Terms, together with our Privacy Policy and any in-app disclosures presented at purchase, constitute the entire agreement between you and BodyPal concerning the Service, and they supersede any prior agreements or understandings.
14b. Severability
If any provision of these Terms is found unenforceable by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
14c. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of BodyPal.
14d. Assignment
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, or sale of all or substantially all of our assets.
15. Governing law
These Terms are governed by the laws of Bulgaria, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved in the competent courts of Plovdiv, Bulgaria, except where applicable law gives you the right to bring claims locally.
15a. EU online dispute resolution
The European Commission provides an online dispute resolution platform ("ODR platform") at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute settlement proceedings before a consumer arbitration board.
16. Apple-specific terms
If you obtained BodyPal through the Apple App Store, you acknowledge that:
- These Terms are between you and BodyPal, not Apple. Apple is not responsible for the Service or its content.
- Apple has no obligation to furnish maintenance or support for BodyPal.
- If BodyPal fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no further warranty obligation regarding BodyPal.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
These Terms incorporate Apple's standard Licensed Application End User License Agreement (EULA), which applies to your use of BodyPal except where these Terms are more specific or more restrictive.
